Disney is urging a Florida state court to dismiss a wrongful death lawsuit by Jeffrey Piccolo, asserting that he agreed to arbitration when he signed up for Disney+ and purchased tickets for Walt Disney World. Piccolo’s tragic claim is tied to the death of his wife, Kanokporn Tangsuan, who suffered a fatal allergic reaction after dining at the Raglan Road restaurant in Disney Springs in October 2023.

Piccolo alleges that despite multiple assurances from restaurant staff that her meal contained no dairy or nuts, his wife began struggling to breathe shortly after the meal and later died at a hospital. Disney, however, counters that Piccolo agreed to binding arbitration for all disputes involving Disney and its affiliates when he subscribed to Disney+ in November 2019 and again when he bought the park tickets.

Disney’s legal response, filed in May, emphasizes the arbitration clause’s applicability to anyone for whom Piccolo bought tickets, which includes his late wife. Currently, Piccolo is seeking at least $50,000 in damages, excluding further costs and interest post-judgment.

Representatives for both Disney and Piccolo have yet to offer further comments. This unusual legal wrinkle underscores the complex nature of terms and conditions that many often overlook in digital and ticket purchases.
